TERMS AND CONDITIONS

1. Agreement Between User and Glass Restore LLC
1.1
Welcome to theglassrestore.com (the “Site”). The Site is owned and operated by Glass Restore LLC, a California limited liability company (“Glass Restore,” “Company,” “we,” “us,” or “our”).
1.2
These Terms and Conditions (“Terms”) govern your access to and use of the Site and any products, services, training programs, courses, consultations, communities, tools, supplies, materials, and related offerings made available by Glass Restore.
1.3
By accessing the Site, creating an account, purchasing a product or service, accessing training materials, joining a community, or otherwise using our Services, you acknowledge that you have read, understood, and agreed to these Terms.
1.4
If you do not agree to these Terms, you must not access or use the Site or Services.
1.5
Certain products or services may be subject to additional written terms presented on the applicable product page, checkout page, order form, training agreement, or service agreement. Those additional terms are incorporated into these Terms by reference.
1.6
If an additional written agreement expressly conflicts with these Terms, the additional written agreement will control only with respect to the particular product or service covered by that agreement.
2. Definitions
2.1 “Services”
“Services” includes the Site and all educational, consulting, commercial, community, digital, and physical offerings made available by Glass Restore.
2.2 “Digital Products”
“Digital Products” includes online courses, videos, documents, templates, guides, calculators, checklists, business systems, sales materials, technical materials, downloads, recordings, and other electronically delivered content.
2.3 “Training”
“Training” includes online training, Certified Training, in-person or remote instruction, demonstrations, workshops, technical instruction, business education, and related educational programs.
2.4 “Consulting Services”
“Consulting Services” includes private mentorship, Zoom consultations, technical consultations, business consultations, support sessions, and other scheduled services.
2.5 “Physical Products”
“Physical Products” includes kits, tools, polishing pads, accessories, supplies, equipment, documents, bags, and other tangible goods.
2.6 “Community”
“Community” includes any private Telegram group, student group, supplier community, forum, messaging group, or other communication area operated or authorized by Glass Restore.
2.7 “Certified Student”
“Certified Student” means an individual who has satisfied the applicable course-completion requirements and has been issued a certificate by Glass Restore.
3. Service Overview
3.1
Glass Restore provides educational content, technical training, business education, mentorship, consultations, tools, supplies, communities, and related services concerning professional glass restoration and the operation of a glass restoration business.
3.2
Training may address subjects including:
a. glass scratch removal;
b. acid graffiti restoration;
c. hard-water stain removal;
d. surface damage restoration;
e. glass polishing techniques;
f. equipment and tool use;
g. estimating and pricing;
h. sales and marketing;
i. client acquisition;
j. business systems;
k. customer communication;
l. commercial glass restoration operations; and
m. other related subjects.
3.3
Glass Restore is intended for people who are willing to invest the time, effort, practice, judgment, and resources necessary to learn and apply the information provided.
3.4
Purchasing a product or service does not guarantee that the purchaser will complete the program, develop a particular skill level, obtain customers, operate a profitable business, or achieve any particular result.
4. Eligibility and Age Requirements
4.1
You must be at least eighteen years old and legally capable of entering into a binding agreement to independently purchase or use the Services.
4.2
A person under eighteen may access the Services only with the express authorization, supervision, and financial responsibility of a parent or legal guardian.
4.3
Certain tools, machinery, glass surfaces, chemicals, and procedures discussed in the Training may be unsuitable or dangerous for minors.
4.4
Glass Restore does not knowingly collect personal information from children under thirteen.
4.5
If Glass Restore learns that information from a child under thirteen has been collected without legally valid parental authorization, Glass Restore may delete the information and terminate the related account.
5. Privacy
5.1
Your use of the Site and Services is also governed by the Glass Restore Privacy Policy.
5.2
The Privacy Policy explains how Glass Restore may collect, use, maintain, disclose, and protect personal information.
5.3
By using the Site or Services, you acknowledge that information may be processed by service providers that support payment processing, website hosting, course delivery, email communications, analytics, shipping, customer support, scheduling, and other business functions.
5.4
The Privacy Policy is incorporated into these Terms by reference.
6. Electronic Communications
6.1
Visiting the Site, creating an account, submitting a form, making a purchase, or sending an email to Glass Restore constitutes electronic communication.
6.2
You consent to receive agreements, receipts, notices, disclosures, account communications, order communications, and other legally required information electronically.
6.3
You agree that electronic communications provided by email, through the Site, through your account, or through another electronic system satisfy any legal requirement that such communication be in writing.
6.4
Transactional communications related to an order, account, scheduled service, security issue, legal notice, or service delivery are not optional marketing communications.
6.5
Marketing communications will be subject to applicable law and any available unsubscribe or opt-out rights.
6.6
You are responsible for maintaining an accurate email address and checking your email, spam folder, account, and other designated communication channels.
7. User Accounts
7.1
You may be required to create an account to access Digital Products, Training, Consulting Services, or Communities.
7.2
You agree to provide accurate, current, and complete information.
7.3
You are responsible for maintaining the confidentiality of your username, password, access links, authentication information, and devices.
7.4
You are responsible for all activity conducted through your account unless applicable law provides otherwise.
7.5
You must notify Glass Restore promptly if you believe your account or access credentials have been compromised.
7.6
Glass Restore is not responsible for unauthorized access resulting from your disclosure, sharing, loss, or mishandling of account credentials.
8. Individual-Use Access
8.1
Unless Glass Restore provides express written authorization otherwise, each purchase and account is licensed to one individual only.
8.2
You may not share your account, password, course access, private links, downloads, recordings, Community access, or other restricted materials with another person.
8.3
A business purchase does not automatically provide access to all owners, employees, independent contractors, family members, partners, franchisees, or affiliates of that business.
8.4
Access for multiple employees or members of one organization requires a separate written arrangement, team license, enterprise license, or other authorization from Glass Restore.
8.5
Glass Restore may use reasonable technical and administrative methods to detect account sharing, unusual account activity, excessive simultaneous access, unauthorized copying, or other misuse.
9. Products and Services
9.1
Glass Restore may offer one or more of the following:
a. online courses;
b. Certified Training;
c. private mentorship;
d. Zoom consultations;
e. technical consultations;
f. business consultations;
g. physical glass restoration kits;
h. tools and supplies;
i. private supplier or student Communities;
j. downloadable materials;
k. live or recorded workshops; and
l. other related products and services.
9.2
The availability, contents, format, price, duration, included features, bonuses, support level, and access conditions of each offering will be described on the applicable sales page, product page, checkout page, order form, or written agreement.
9.3
A Community may be included at no additional charge with a qualifying program or may be sold separately for a one-time price.
9.4
Access to a Community is not a recurring subscription unless a separate written offer expressly and clearly states otherwise.
9.5
Under the current purchasing model described by these Terms, Glass Restore does not automatically renew purchases or automatically impose recurring subscription charges.
10. One-Time Purchases and No Automatic Renewal
10.1
Unless the checkout page expressly and clearly states otherwise before purchase, all purchases covered by these Terms are one-time purchases.
10.2
Glass Restore will not automatically charge you on a monthly, annual, or other recurring basis for a one-time purchase.
10.3
You will be charged the purchase price, applicable taxes, shipping charges, and any other charges clearly disclosed during checkout.
10.4
A payment plan, installment arrangement, or buy-now-pay-later arrangement is not a subscription. It represents payment of an agreed purchase price in multiple payments.
10.5
If an installment or financing option is provided by a third party, your use of that service may be governed by a separate agreement between you and that provider.
11. Prices, Currency, and Payment
11.1
Current prices are displayed on the applicable product page, offer page, order form, or checkout page.
11.2
Glass Restore may change prices, discounts, packages, bonuses, availability, or promotional offers at any time before purchase.
11.3
A price change does not retroactively change the amount charged for a completed purchase unless required by law or agreed in writing.
11.4
Prices are presented and settled in United States dollars unless the checkout page expressly states otherwise.
11.5
A purchaser may use a payment method denominated in another currency if the applicable bank, card network, payment provider, or checkout system converts the transaction into United States dollars.
11.6
Foreign-exchange rates, conversion charges, international transaction fees, bank fees, and similar charges are determined by third parties and are the purchaser’s responsibility.
11.7
Payments may be processed through WooCommerce and one or more payment processors or payment methods displayed during checkout.
11.8
Available payment methods may include credit cards, debit cards, Apple Pay, Google Pay, PayPal, digital wallets, or other methods displayed during checkout.
11.9
The availability of a particular payment card, card network, wallet, processor, or payment method is not guaranteed and may change without notice.
11.10
You represent that:
a. you are authorized to use the selected payment method;
b. the billing information you provide is accurate;
c. the transaction does not violate applicable law; and
d. sufficient funds or credit are available.
11.11
Glass Restore may refuse, cancel, or hold an order when fraud, payment failure, unauthorized activity, incorrect pricing, sanctions issues, identity concerns, inventory issues, or other legitimate concerns are suspected.
11.12
If an order is canceled by Glass Restore before delivery and no part of the product or service has been provided, the amount collected for that canceled order will be refunded, subject to applicable law.
12. Taxes and Additional Charges
12.1
You are responsible for applicable sales tax, use tax, customs duties, import fees, brokerage fees, VAT, bank fees, currency-conversion charges, and other governmental or third-party charges unless the checkout page states that they are included.
12.2
Glass Restore may collect taxes when legally required.
12.3
International customers are responsible for determining and paying any import duties, taxes, customs charges, or similar fees imposed by their jurisdiction.
13. Digital Product Delivery and Access
13.1
Digital Products may be delivered through an online account, course platform, email, download link, private page, video platform, messaging service, or another electronic delivery method.
13.2
Access begins when the applicable Digital Product is made available to you, whether or not you immediately watch, download, or complete it.
13.3
Course access is provided for as long as Glass Restore continues to operate and maintain the applicable platform, course, program, or replacement service.
13.4
“Lifetime access,” if that phrase appears in an offer, means access for the commercially reasonable life of the applicable course or platform as maintained by Glass Restore. It does not mean the natural lifetime of the purchaser and does not create an obligation to operate the course or platform forever.
13.5
Glass Restore does not guarantee that any course, platform, Community, lesson, tool, feature, support channel, or Digital Product will remain available permanently.
13.6
Glass Restore may, at any time:
a. update course materials;
b. replace lessons;
c. add or remove modules;
d. correct information;
e. reorganize content;
f. modify the format;
g. change instructors;
h. replace software or platforms;
i. remove outdated or unnecessary materials;
j. discontinue public sale of a course;
k. consolidate courses or Communities; or
l. discontinue a course, platform, Community, or Service.
13.7
Discontinuing the public sale of a course does not necessarily terminate existing access, but Glass Restore may discontinue existing access if the applicable course, platform, program, or service is discontinued.
13.8
When reasonably practical, Glass Restore may provide existing customers with advance notice, replacement access, downloadable materials, substitute content, or another commercially reasonable alternative. Glass Restore is not obligated to maintain an identical format or platform.
13.9
Temporary interruptions caused by maintenance, updates, security issues, third-party failures, internet disruptions, emergencies, or events outside Glass Restore’s reasonable control do not constitute a breach of these Terms.
14. Digital Product Refund Policy
14.1
A purchaser may request a refund for a Digital Product only before accessing or opening the Digital Product.
14.2
For purposes of this policy, a Digital Product will be considered accessed or opened when any of the following occurs:
a. the purchaser logs into or enters the course or restricted product area;
b. the purchaser opens, streams, views, plays, or downloads any lesson, module, document, recording, template, guide, or other protected material;
c. the purchaser uses a private access link;
d. the purchaser joins a Community included with the purchase;
e. the purchaser attends any live component included with the purchase; or
f. Glass Restore’s records otherwise reasonably indicate that protected content or benefits were accessed.
14.3
Once a Digital Product has been accessed or opened, the purchase is final and nonrefundable, except when a refund is required by applicable law.
14.4
Not completing the course, changing your mind, lacking time, failing to practice, being dissatisfied with your personal progress, or deciding not to operate a glass restoration business does not create a right to a refund after access has begun.
14.5
To request an eligible refund before opening or accessing a Digital Product, you must contact:
support@theglassrestore.com
14.6
The refund request must identify the purchaser, order, product, purchase date, and reason for the request.
14.7
If a refund is granted, all related licenses, access rights, certificates, bonuses, downloads, Communities, and support rights immediately terminate.
15. Scheduled Consultations, Mentorship, and Appointments
15.1
Consulting Services may include private mentorship, Zoom consultations, technical consultations, business consultations, and other scheduled sessions.
15.2
Payment reserves the agreed appointment time and compensates Glass Restore for preparation, scheduling, and availability.
15.3
A purchaser may request to cancel or reschedule a scheduled session by providing at least twenty-four hours’ notice before the scheduled start time.
15.4
When timely notice is provided, Glass Restore may:
a. reschedule the session;
b. issue account credit; or
c. provide another remedy described in the applicable offer.
15.5
Unless Glass Restore expressly agrees otherwise in writing, Consulting Services are nonrefundable once purchased.
15.6
A cancellation made less than twenty-four hours before the scheduled start time is considered a late cancellation and is nonrefundable.
15.7
Failure to attend, failure to join the call, failure to respond, or arrival too late to reasonably conduct the session is considered a no-show.
15.8
A no-show session is considered delivered and is nonrefundable.
15.9
Glass Restore is not obligated to extend the scheduled ending time because the purchaser arrived late.
15.10
If Glass Restore cancels a scheduled session, Glass Restore will provide a rescheduled session, account credit, or refund for the undelivered session.
15.11
Technical problems caused by the purchaser’s internet connection, device, software, microphone, camera, login credentials, or failure to install required software generally do not create a right to a refund.
16. Physical Product Orders
16.1
Physical Products are subject to availability.
16.2
Product images, packaging, labeling, design, colors, containers, accessories, specifications, and included components may change when reasonably necessary.
16.3
Glass Restore may substitute a substantially equivalent component when the originally displayed component is unavailable, provided the substitution does not materially reduce the intended function of the product.
16.4
Estimated shipping and delivery dates are estimates only and are not guaranteed.
16.5
Glass Restore is not responsible for delays caused by carriers, weather, customs, labor interruptions, address errors, recipient unavailability, natural disasters, government action, or other events outside Glass Restore’s reasonable control.
16.6
The purchaser is responsible for providing an accurate and complete shipping address.
16.7
Additional shipping charges resulting from an incorrect address, refused delivery, failed delivery, unclaimed package, or requested rerouting may be charged to the purchaser.
17. Physical Product Return Policy
17.1
Subject to this section, an eligible unused Physical Product may be returned within thirty calendar days after confirmed delivery.
17.2
To qualify for a return, the product must:
a. be unused;
b. be unaltered;
c. be undamaged after delivery;
d. contain all original parts, accessories, manuals, and components;
e. be returned in its original packaging when reasonably possible; and
f. be in a condition suitable for resale.
17.3
A product is not eligible for return if it has been used, tested on glass, installed, modified, damaged, contaminated, consumed, mixed, opened in a manner that prevents resale, or is missing components.
17.4
The purchaser must contact support@theglassrestore.com before returning a product and obtain return instructions.
17.5
Unauthorized returns may be refused.
17.6
Except for an incorrect, defective, or materially damaged product sent by Glass Restore, the purchaser is responsible for:
a. return shipping costs;
b. suitable protective packaging;
c. tracking;
d. insurance when appropriate; and
e. the risk of loss or damage during return transportation.
17.7
Original shipping charges are nonrefundable unless Glass Restore sent an incorrect product or the product arrived materially defective or damaged.
17.8
If Glass Restore sent the wrong product, or if a product arrived materially defective or damaged, the purchaser must contact Glass Restore within a reasonable time and provide photographs, order information, packaging information, and other reasonably requested evidence.
17.9
For a verified incorrect, defective, or materially damaged product, Glass Restore may provide:
a. replacement parts;
b. replacement product;
c. repair;
d. store credit;
e. a prepaid return label; or
f. a refund.
17.10
Glass Restore will select a commercially reasonable remedy consistent with applicable law.
17.11
Any approved refund may be reduced by the value of missing components, customer-caused damage, use, contamination, or diminished condition, to the extent permitted by law.
17.12
Refunds are generally issued to the original payment method after the returned product is received and inspected.
18. Order Inspection and Shipping Claims
18.1
You should inspect your order promptly after delivery.
18.2
Claims concerning missing items, incorrect items, visible shipping damage, or material product defects should be submitted to support@theglassrestore.com with supporting photographs and order information.
18.3
You must retain the product, shipping box, packaging, labels, and carrier documentation while a claim is being investigated.
18.4
Discarding packaging, altering the product, continuing to use the product after discovering a problem, or failing to provide requested information may limit Glass Restore’s ability to investigate or resolve the claim.
19. Certification
19.1
Glass Restore may issue a certificate to an individual who completes the applicable Certified Training requirements.
19.2
The applicable course description may require completion of lessons, modules, acknowledgments, exercises, testing, practical work, or other requirements.
19.3
A Glass Restore certificate confirms only that the identified individual completed the applicable Glass Restore educational program according to Glass Restore’s internal requirements.
19.4
A Glass Restore certificate is not:
a. a government-issued license;
b. a contractor license;
c. a professional license;
d. an occupational license;
e. a permit;
f. an insurance policy;
g. a government accreditation;
h. a guarantee of skill;
i. a guarantee of work quality;
j. a guarantee of employment; or
k. authorization to violate local law.
19.5
Certified Students remain independently responsible for verifying and complying with all licensing, registration, insurance, tax, safety, employment, consumer-protection, environmental, and business requirements applicable to their activities.
20. Use of “Glass Restore Certified”
20.1
A Certified Student with an active, valid, and unrevoked certificate may truthfully identify themselves as:
“Glass Restore Certified”
20.2
Permission to use “Glass Restore Certified” is personal, limited, nonexclusive, nontransferable, revocable, and subject to these Terms.
20.3
A Certified Student may not:
a. claim that Glass Restore owns, operates, supervises, guarantees, or insures the student’s independent business;
b. claim to be an employee, agent, franchisee, legal representative, partner, or authorized contractor of Glass Restore;
c. claim government accreditation or licensing;
d. imply that Glass Restore guarantees the student’s services;
e. alter certification materials in a misleading manner;
f. permit another person or business to use the certificate;
g. use the certification after expiration, suspension, or revocation; or
h. make false statements about the Training or certification.
20.4
Use of Glass Restore logos, trademarks, badges, graphics, or brand assets requires compliance with any brand guidelines and any separate written authorization provided by Glass Restore.
20.5
Certification does not create an employment, agency, partnership, franchise, joint venture, fiduciary, or representative relationship.
21. Suspension or Revocation of Certification
21.1
Glass Restore may suspend or revoke certification when it reasonably believes that a Certified Student has engaged in:
a. fraud;
b. misrepresentation;
c. unsafe work;
d. serious or repeated violation of professional standards;
e. illegal conduct related to the certified activity;
f. copying or distributing Training materials;
g. unauthorized resale of Training;
h. sharing course access;
i. false advertising;
j. misuse of the Glass Restore name, certification, logo, or trademarks;
k. impersonation;
l. harassment or abuse;
m. disclosure of confidential Community or supplier information; or
n. conduct that materially harms customers, students, Glass Restore, or the integrity of the certification program.
21.2
Glass Restore may request information or an explanation before making a certification decision but is not obligated to conduct a formal hearing.
21.3
Upon suspension or revocation, the individual must immediately stop representing themselves as Glass Restore Certified and remove related badges, statements, and materials from advertising, websites, social media, documents, vehicles, and business listings.
21.4
Suspension or revocation resulting from the individual’s misconduct does not create a right to a refund.
22. Educational Purpose and Independent Decision-Making
22.1
The Services provide education, demonstrations, practical examples, opinions, experience, general information, and business guidance.
22.2
The Services are not a substitute for independent professional judgment.
22.3
Glass Restore does not inspect every job site, glass surface, coating, frame, building, tool, chemical, customer agreement, or local legal requirement involved in a student’s work.
22.4
You remain solely responsible for deciding:
a. whether to perform a job;
b. whether a surface is suitable for restoration;
c. which tools and procedures to use;
d. whether to perform a test area;
e. whether to stop work;
f. whether specialist assistance is necessary;
g. what price to charge;
h. what representations to make to a customer;
i. whether licenses, permits, registrations, or insurance are appropriate or required; and
j. whether your activities comply with applicable law.
22.5
A demonstration that worked in one situation does not guarantee that the same method will produce the same result on another surface, property, or project.
23. Glass Restoration Risks
23.1
Glass restoration involves material risks, including:
a. glass breakage;
b. cracking;
c. scratching;
d. optical distortion;
e. haze;
f. waves or lensing;
g. heat damage;
h. edge damage;
i. seal failure;
j. coating damage;
k. tint damage;
l. film damage;
m. frame damage;
n. property damage;
o. equipment damage;
p. chemical exposure;
q. electrical hazards;
r. bodily injury; and
s. customer disputes.
23.2
Different glass products and installations may react differently to polishing, pressure, heat, chemicals, abrasives, pads, machinery, or other processes.
23.3
You are responsible for identifying or obtaining appropriate information concerning:
a. tempered glass;
b. laminated glass;
c. heat-strengthened glass;
d. coated glass;
e. low-emissivity coatings;
f. mirrored surfaces;
g. tinted glass;
h. window films;
i. treated surfaces;
j. insulated glass units;
k. specialty glass;
l. decorative glass;
m. fabrication defects; and
n. other surface or installation conditions.
23.4
You should use an appropriate test area, inspect the surface, document preexisting damage, obtain customer authorization, follow equipment instructions, follow product labels, and stop work when conditions appear unsafe or uncertain.
23.5
You assume responsibility for your application of the Training and for work performed by you, your employees, subcontractors, agents, or business.
24. Tools, Equipment, and Chemical Safety
24.1
Tools, polishing machines, electrical equipment, pads, compounds, chemicals, and related materials must be used carefully and in accordance with applicable instructions, labels, safety data, manufacturer guidance, and law.
24.2
You are responsible for obtaining and using appropriate personal protective equipment.
24.3
You are responsible for ventilation, electrical safety, fall protection, ladder safety, site control, customer protection, environmental handling, storage, transportation, cleanup, and disposal.
24.4
Glass Restore does not manufacture or sell proprietary chemical products unless a specific product page expressly states otherwise.
24.5
References to third-party chemicals or products are educational information and do not create a warranty by Glass Restore concerning the third-party product.
24.6
You must review and follow the applicable manufacturer’s instructions, warnings, safety data sheets, and restrictions.
24.7
You must not use a product, tool, or procedure when you lack the necessary knowledge, competence, protective equipment, or safe working conditions.
25. Business, Legal, Tax, and Insurance Disclaimer
25.1
Glass Restore may provide general education concerning business systems, marketing, pricing, estimates, sales, operations, customer acquisition, and commercial strategy.
25.2
Glass Restore does not provide legal, tax, accounting, investment, insurance, engineering, architectural, medical, or other regulated professional advice.
25.3
No attorney-client, accountant-client, financial-adviser, insurance-agent, fiduciary, employment, or other professional relationship is created through the Services.
25.4
You are independently responsible for determining whether your business requires:
a. a business license;
b. contractor licensing;
c. registration;
d. permits;
e. insurance;
f. bonding;
g. tax registration;
h. employee or contractor compliance;
i. safety compliance; or
j. other legal authorization.
25.5
Glass Restore does not represent that insurance is universally required or universally unnecessary. Requirements and appropriate risk-management decisions vary by jurisdiction, customer, contract, worksite, and activity.
25.6
Any statement that a particular type of work may not require a particular license or insurance in one situation must not be treated as a universal legal conclusion.
26. No Earnings or Business-Result Guarantee
26.1
Glass Restore does not guarantee that you will:
a. earn money;
b. earn money immediately;
c. recover the cost of your purchase;
d. obtain customers;
e. obtain contracts;
f. receive leads;
g. close sales;
h. achieve a specific hourly rate;
i. achieve a specific project price;
j. operate a profitable business;
k. avoid losses;
l. achieve employment; or
m. obtain any particular financial or commercial result.
26.2
Statements about possible earnings, hourly rates, project values, replacement savings, revenue, profit, customer demand, speed of launching a service, or student success are examples, goals, estimates, illustrations, or descriptions of possible outcomes unless expressly stated otherwise.
26.3
Individual results vary based on factors including:
a. effort;
b. skill;
c. practice;
d. judgment;
e. experience;
f. market conditions;
g. location;
h. competition;
i. pricing;
j. sales ability;
k. marketing;
l. customer demand;
m. business expenses;
n. legal requirements;
o. quality of work;
p. reputation;
q. available time; and
r. other circumstances outside Glass Restore’s control.
26.4
Past results, instructor results, student results, testimonials, case studies, and examples do not guarantee future or typical results.
26.5
You should not purchase any product or service with money you cannot afford to lose or based solely on an expectation of immediate earnings.
27. Testimonials, Reviews, and Case Studies
27.1
Testimonials, reviews, photographs, videos, before-and-after materials, interviews, and case studies may describe the experience of a particular customer or student.
27.2
Individual experiences are not guarantees that every purchaser will receive the same result.
27.3
Glass Restore does not authorize any person to submit a fake, fabricated, misleading, or materially altered review or testimonial.
27.4
Anyone providing a testimonial must disclose any material connection, compensation, free product, discount, employment, affiliation, or other incentive when required by law.
27.5
Glass Restore may edit a testimonial for grammar, length, formatting, privacy, or clarity, but will not knowingly change its material meaning.
28. User Submissions and Marketing Permission
28.1
“Submissions” includes reviews, testimonials, feedback, photographs, videos, before-and-after results, comments, messages, project descriptions, questions, and other material you voluntarily provide to Glass Restore or post in an area operated by Glass Restore.
28.2
You retain ownership of any rights you legally hold in your Submissions.
28.3
By voluntarily submitting or posting a Submission, you grant Glass Restore a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to:
a. store;
b. reproduce;
c. edit;
d. format;
e. translate;
f. publish;
g. display;
h. distribute;
i. promote;
j. advertise; and
k. otherwise use the Submission in connection with Glass Restore’s business, Services, education, social media, website, advertising, and marketing.
28.4
This permission includes the right to use your submitted name, business name, general location, voice, image, likeness, testimonial, and project results when included in or submitted with the material.
28.5
No additional compensation is owed for an authorized use of a Submission unless Glass Restore agrees otherwise in writing.
28.6
You represent that:
a. you own the Submission or have all necessary rights and permissions;
b. the Submission is truthful;
c. the Submission does not infringe intellectual property, privacy, publicity, contractual, or other rights;
d. you have permission to show the property, customer work, people, addresses, identifying information, and other content appearing in the Submission; and
e. Glass Restore’s authorized use will not violate applicable law.
28.7
Glass Restore may decide not to use or may remove any Submission.
28.8
Glass Restore may request additional written consent for particular advertising uses, but is not required to do so when the license in this section validly covers the proposed use.
29. Intellectual Property Ownership
29.1
The Site and Services, including their text, videos, lessons, graphics, photographs, logos, names, trademarks, designs, course structure, methods of presentation, worksheets, templates, calculators, checklists, scripts, documents, downloads, software, and compilations, are owned by or licensed to Glass Restore and are protected by intellectual-property law.
29.2
Purchasing a product gives you only the limited right to access and use that product in accordance with these Terms.
29.3
A purchase does not transfer ownership of any copyright, trademark, trade secret, course, method, recording, platform, design, brand, or other intellectual property.
29.4
All rights not expressly granted are reserved by Glass Restore and its licensors.
30. Limited License
30.1
Subject to payment and compliance with these Terms, Glass Restore grants you a limited, personal, nonexclusive, nontransferable, nonsublicensable, and revocable license to access and use purchased Digital Products for your own education and lawful business activities.
30.2
You may use knowledge you personally learn through the Training to perform glass restoration and operate your business.
30.3
You may not copy or distribute the expression, presentation, documents, videos, systems, templates, recordings, protected downloads, or other proprietary content used to teach that knowledge.
30.4
The license ends when your access expires, the applicable Service is discontinued, your purchase is refunded, or your access is terminated for violation of these Terms.
31. Prohibited Use of Intellectual Property
31.1
Without prior written permission from Glass Restore, you may not:
a. copy course materials;
b. record the screen, audio, or video of Training;
c. download content except through an authorized download feature;
d. reproduce or republish content;
e. upload content to YouTube, Telegram, cloud storage, social media, forums, file-sharing services, artificial-intelligence systems, or other platforms;
f. distribute materials to employees, partners, customers, friends, students, or third parties;
g. sell, sublicense, rent, lend, or transfer access;
h. create a competing course using copied or substantially reproduced materials;
i. remove copyright, trademark, attribution, or proprietary notices;
j. reverse engineer software or access controls;
k. bypass security restrictions;
l. scrape or automatically extract content;
m. use content to train a commercial model or database;
n. impersonate Glass Restore;
o. register confusingly similar names or domains;
p. falsely claim endorsement, affiliation, or authorization; or
q. use Glass Restore intellectual property for an unlawful or misleading purpose.
31.2
Unauthorized copying, account sharing, distribution, recording, resale, or commercial exploitation may result in immediate termination without refund and may expose the responsible person to legal claims.
32. Community Access
32.1
Glass Restore may operate one or more private Communities, including Telegram groups.
32.2
Community access may be:
a. included with a program;
b. offered as a bonus;
c. provided without charge;
d. sold for a one-time payment; or
e. granted at Glass Restore’s discretion.
32.3
Community access continues only while the applicable Community is operated and while the user remains in compliance with these Terms.
32.4
Glass Restore does not guarantee permanent Community access, continuous activity, a particular number of members, a particular response time, or the continued participation of any instructor or member.
32.5
Glass Restore may reorganize, merge, move, archive, close, replace, or discontinue a Community at any time.
32.6
Community access is personal and may not be shared or transferred.
33. Community Rules
33.1
When using a Community, you may not:
a. advertise or promote unrelated products or services;
b. advertise competing training or communities;
c. solicit members for another business, group, course, or opportunity;
d. recruit, divert, or attempt to move members into another group;
e. spam members;
f. send unsolicited private messages;
g. collect member names, phone numbers, email addresses, customer data, or other information without authorization;
h. share supplier names, supplier contacts, private prices, special terms, discounts, account details, or purchasing arrangements outside the authorized Community;
i. share protected course materials;
j. distribute screenshots or recordings of private discussions;
k. disclose confidential business or customer information;
l. harass, threaten, stalk, abuse, defame, or discriminate against others;
m. post obscene, unlawful, fraudulent, dangerous, or infringing content;
n. impersonate another person;
o. provide knowingly dangerous technical instructions;
p. distribute malware or harmful files;
q. conduct surveys, contests, chain letters, or pyramid schemes without authorization;
r. interfere with Community operations; or
s. violate applicable law.
33.2
Glass Restore may moderate, edit, restrict, reject, or remove Community content in its discretion.
33.3
Glass Restore has no obligation to monitor every communication and does not endorse every statement made by members.
33.4
Members act independently, and Glass Restore is not responsible for private transactions, advice, agreements, disputes, or relationships between members.
34. Supplier Information and Confidentiality
34.1
Supplier contacts, private pricing, negotiated rates, access methods, purchasing arrangements, Community discussions, internal documents, and other nonpublic information provided by Glass Restore are confidential.
34.2
You may use authorized supplier information only for your own lawful business operations.
34.3
You may not:
a. sell supplier information;
b. publish supplier information;
c. distribute it outside your authorized business;
d. use it to operate a competing supplier directory or Community;
e. contact suppliers while falsely claiming to represent Glass Restore;
f. disclose negotiated pricing or private access terms; or
g. interfere with Glass Restore’s supplier relationships.
34.4
Supplier availability, prices, inventory, shipping, quality, terms, and willingness to sell are controlled by the supplier and may change.
34.5
Glass Restore does not guarantee that a supplier will approve an account, maintain inventory, offer a particular price, ship to a particular country, or continue doing business with any person.
35. Third-Party Products and Services
35.1
The Site or Services may refer or link to third-party websites, software, platforms, tools, chemicals, equipment, suppliers, payment processors, shipping carriers, or other businesses.
35.2
Third parties are independent and are not controlled by Glass Restore unless expressly stated otherwise.
35.3
A reference or link does not necessarily constitute an endorsement, warranty, agency relationship, partnership, or guarantee.
35.4
Glass Restore is not responsible for:
a. third-party content;
b. third-party terms;
c. third-party privacy practices;
d. product availability;
e. pricing;
f. shipping;
g. product performance;
h. account approval;
i. service interruptions; or
j. disputes between you and a third party.
35.5
You are responsible for reviewing and complying with third-party terms and instructions.
36. International Users
36.1
Glass Restore may make its online Training available to users in multiple countries.
36.2
Approximately fifty percent of Glass Restore students may be located outside the United States. This statement describes the international nature of the audience and is not a guarantee concerning current enrollment, country availability, or individual outcomes.
36.3
Glass damage exists worldwide, and the general techniques, marketing concepts, sales principles, and business systems taught by Glass Restore may be applied in different markets, subject to local conditions and law.
36.4
Tool availability, glass products, construction methods, electrical standards, chemical regulations, licensing requirements, insurance requirements, tax obligations, consumer laws, business rules, import restrictions, and professional practices vary by country and jurisdiction.
36.5
International users are independently responsible for complying with all applicable local laws and requirements.
36.6
Glass Restore does not represent that every product, tool, supplier, procedure, business model, or legal structure described in the Training is available, suitable, legal, or appropriate in every country.
36.7
Physical Product shipping may be unavailable to certain locations even when Digital Products remain available.
37. Sanctions and Restricted Transactions
37.1
Glass Restore will not knowingly engage in a transaction prohibited by applicable United States sanctions, export controls, trade restrictions, anti-money-laundering requirements, or other applicable law.
37.2
Glass Restore may screen purchasers, recipients, payment methods, addresses, transactions, and destinations when reasonably necessary.
37.3
Glass Restore may refuse, hold, cancel, or refund a transaction when required by law or when sanctions, fraud, export, payment, or compliance concerns cannot reasonably be resolved.
37.4
The existence of a sanctions program involving a country does not necessarily mean that every transaction involving that country is prohibited. Glass Restore will apply restrictions based on the applicable law, parties, territory, product, payment, and transaction.
37.5
You may not use the Services in violation of sanctions, export controls, or other trade restrictions.
38. Chargebacks and Payment Disputes
38.1
Before initiating a chargeback or payment dispute, you agree to contact support@theglassrestore.com and provide Glass Restore a reasonable opportunity to investigate and resolve the issue.
38.2
A chargeback must not be used to avoid a valid refund policy, retain a product without payment, obtain free access, or make a knowingly false claim.
38.3
If a chargeback, payment reversal, suspected fraud claim, or unauthorized-payment claim is initiated, Glass Restore may immediately suspend access to:
a. courses;
b. accounts;
c. Communities;
d. certification privileges;
e. downloads;
f. support; and
g. related Services
while the dispute is pending.
38.4
If the payment is permanently reversed, related access and licenses may be terminated.
38.5
Glass Restore may submit order records, access logs, communications, delivery records, signed agreements, IP information, Community records, and other relevant evidence to the payment processor, bank, card network, financing provider, or legal authority.
38.6
Nothing in this section prevents a customer from exercising a legitimate right under applicable law.
39. Suspension and Termination
39.1
Glass Restore may suspend, restrict, or terminate access when it reasonably believes that a user has:
a. shared an account;
b. copied protected materials;
c. recorded protected content;
d. resold access;
e. distributed course materials;
f. initiated a fraudulent or abusive chargeback;
g. harassed or threatened another person;
h. advertised or solicited inside a Community without authorization;
i. disclosed supplier or confidential information;
j. misused certification;
k. violated intellectual-property rights;
l. engaged in fraud;
m. created a security risk;
n. violated applicable law; or
o. materially violated these Terms.
39.2
Suspension or termination for user misconduct may occur without advance notice when immediate action is reasonably necessary to protect Glass Restore, customers, members, intellectual property, payment systems, suppliers, or the public.
39.3
Termination caused by the user’s violation does not create a right to a refund.
39.4
Upon termination, the user must stop accessing and using restricted content, certification assets, Communities, and other terminated Services.
39.5
Sections concerning payment obligations, intellectual property, confidentiality, disclaimers, limitations of liability, indemnification, disputes, and other provisions intended by their nature to survive will remain effective.
40. Site Availability and Changes
40.1
Glass Restore may modify, suspend, discontinue, replace, restrict, or remove any part of the Site or Services.
40.2
Glass Restore may change technical requirements, hosting providers, course platforms, payment processors, Community platforms, features, designs, URLs, and access procedures.
40.3
Glass Restore does not guarantee that the Site or Services will be uninterrupted, secure, error-free, compatible with every device, or free from harmful components.
40.4
You are responsible for maintaining compatible equipment, internet access, software, email access, and account security.
41. Disclaimer of Warranties
41.1
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, SERVICES, DIGITAL PRODUCTS, TRAINING, CONSULTING SERVICES, COMMUNITIES, AND RELATED MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
41.2
GLASS RESTORE DISCLAIMS ALL WARRANTIES NOT EXPRESSLY PROVIDED IN WRITING, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
41.3
GLASS RESTORE DOES NOT WARRANT THAT:
a. the Services will meet every purchaser’s expectations;
b. every method will work on every glass surface;
c. information will always be complete or error-free;
d. access will continue indefinitely;
e. third-party products will perform as expected;
f. a purchaser will become competent without sufficient practice;
g. a purchaser will obtain customers or earn money; or
h. every jurisdiction will permit the activities described.
41.4
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
41.5
Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
42. Limitation of Liability
42.1
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLASS RESTORE AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, INSTRUCTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES.
42.2
THIS EXCLUSION INCLUDES, TO THE MAXIMUM EXTENT PERMITTED BY LAW:
a. lost profits;
b. lost revenue;
c. lost customers;
d. lost contracts;
e. loss of business opportunity;
f. loss of data;
g. business interruption;
h. reputational harm;
i. property damage resulting from the user’s work;
j. customer claims arising from the user’s services; and
k. damages arising from reliance on educational information.
42.3
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLASS RESTORE’S TOTAL AGGREGATE LIABILITY ARISING FROM A PARTICULAR PRODUCT, SERVICE, OR TRANSACTION WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO GLASS RESTORE FOR THAT PARTICULAR PRODUCT, SERVICE, OR TRANSACTION DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
42.4
The limitations in this section apply regardless of the legal theory asserted and even if a party was advised that damages were possible.
42.5
These limitations do not apply to liability that cannot lawfully be limited or excluded.
43. Indemnification
43.1
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Glass Restore and its owners, members, managers, officers, employees, instructors, contractors, agents, affiliates, licensors, and service providers from third-party claims, liabilities, losses, damages, judgments, penalties, costs, and reasonable attorneys’ fees arising from or relating to:
a. your violation of these Terms;
b. your unlawful conduct;
c. your business operations;
d. glass restoration work performed by you or under your direction;
e. bodily injury or property damage caused by your actions;
f. your customer agreements or representations;
g. your Submissions;
h. your infringement of third-party rights;
i. your misuse of Training, certification, supplier information, or Community access;
j. your employees, contractors, partners, or agents; or
k. your violation of licensing, tax, safety, employment, environmental, insurance, or other legal requirements.
43.2
Glass Restore may control the defense of a covered claim with counsel of its choosing.
43.3
You may not settle a claim in a manner that imposes an admission, obligation, or liability on Glass Restore without Glass Restore’s written consent.
44. Informal Dispute Resolution
44.1
Before filing a lawsuit relating to these Terms, the Site, a purchase, or the Services, the complaining party must send a written notice describing the dispute.
44.2
A notice to Glass Restore must be sent to:

44.3
The notice must include:
a. the sender’s full name;
b. contact information;
c. order number, when applicable;
d. a description of the dispute;
e. relevant supporting documents;
f. the amount in dispute, when applicable; and
g. the requested resolution.
44.4
The parties will attempt in good faith to resolve the dispute informally for at least thirty calendar days after receipt of a complete written notice.
44.5
Either party may seek urgent temporary or injunctive relief when reasonably necessary to prevent immediate misuse of intellectual property, unauthorized access, fraud, security harm, disclosure of confidential information, or other irreparable harm.
44.6
This section does not eliminate any deadline that cannot lawfully be waived, but the parties agree to cooperate in reasonably preserving claims during the informal-resolution period.
45. Governing Law and Courts
45.1
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except when applicable law requires otherwise.
45.2
After completion of the informal dispute-resolution procedure, any lawsuit arising out of or relating to these Terms, the Site, a purchase, or the Services must be brought in a state or federal court with jurisdiction in Los Angeles County, California, except when applicable consumer law requires a different forum.
45.3
Each party consents to the personal jurisdiction and venue of those courts, subject to rights that cannot legally be waived.
45.4
These Terms do not contain a mandatory arbitration agreement.
45.5
These Terms do not contain a class-action waiver.
46. Intellectual-Property and Injunctive Relief
46.1
Unauthorized copying, distribution, disclosure, account sharing, certification misuse, trademark misuse, or disclosure of confidential supplier information may cause harm that cannot be adequately repaired by money alone.
46.2
Glass Restore may seek temporary, preliminary, or permanent injunctive relief in addition to other available remedies.
46.3
Nothing in these Terms limits any valid defense or right available under applicable intellectual-property law.
47. Copyright Complaints
47.1
Glass Restore respects intellectual-property rights.
47.2
A person who believes that content on the Site infringes their copyright may send a written notice to:

47.3
The notice should include:
a. identification of the copyrighted work;
b. identification and location of the allegedly infringing material;
c. the complaining party’s contact information;
d. a statement of good-faith belief that the use is unauthorized;
e. a statement that the information is accurate; and
f. the physical or electronic signature of the rights holder or authorized representative.
47.4
Glass Restore may remove or restrict material while reviewing a complaint.
48. Errors and Corrections
48.1
The Site may contain typographical errors, technical errors, outdated information, incorrect prices, omissions, or other inaccuracies.
48.2
Glass Restore may correct errors and update information at any time.
48.3
If a material pricing or product error affects an unfulfilled order, Glass Restore may cancel the affected order and refund the amount paid.
48.4
Glass Restore is not obligated to honor an obvious pricing error when enforcement would be unlawful, commercially unreasonable, or inequitable, subject to applicable law.
49. Force Majeure
49.1
Glass Restore is not responsible for delay or failure caused by events beyond its reasonable control, including:
a. natural disasters;
b. fire;
c. flood;
d. earthquake;
e. severe weather;
f. epidemic or pandemic;
g. war;
h. terrorism;
i. civil disturbance;
j. government action;
k. sanctions;
l. labor disputes;
m. carrier delays;
n. supply shortages;
o. power failures;
p. internet failures;
q. cyberattacks;
r. platform outages; or
s. failure of third-party providers.
49.2
Glass Restore may suspend performance, extend deadlines, provide substitute performance, or cancel affected Services when reasonably necessary.
50. Changes to These Terms
50.1
Glass Restore may update these Terms to reflect changes in the Services, business practices, technology, legal requirements, risk, or operations.
50.2
The updated Terms will display a revised effective date.
50.3
Material changes may be communicated through the Site, email, account notice, checkout notice, or another reasonable method.
50.4
Changes apply prospectively from their effective date unless applicable law permits or requires otherwise.
50.5
Changes will not retroactively eliminate a right that had already accrued when doing so would be unlawful.
50.6
Continued use of the Site or Services after updated Terms take effect constitutes acceptance of the updated Terms when legally enforceable.
51. Assignment
51.1
You may not assign or transfer your account, purchase, course license, Community access, certification, rights, or obligations without written permission from Glass Restore.
51.2
Glass Restore may assign these Terms or transfer the Site, Services, contracts, or related rights as part of a merger, acquisition, restructuring, sale of assets, financing, or other legitimate business transaction.
52. No Waiver
52.1
Failure to enforce a provision does not waive the right to enforce it later.
52.2
A waiver is effective only when made in writing by a person authorized to act for Glass Restore.
52.3
A waiver concerning one event does not automatically waive another event.
53. Severability
53.1
If a provision of these Terms is found invalid, illegal, or unenforceable, the provision will be enforced to the maximum extent permitted by law.
53.2
The remaining provisions will continue in effect.
53.3
When permitted, an invalid provision may be modified only to the minimum extent necessary to make it enforceable while preserving its intended purpose.
54. Entire Agreement
54.1
These Terms, the Privacy Policy, the applicable checkout disclosures, product description, order confirmation, and any additional written agreement constitute the agreement between you and Glass Restore concerning the applicable transaction.
54.2
They replace prior or contemporaneous discussions, statements, communications, and understandings concerning the same subject, except in cases of fraud or when applicable law provides otherwise.
54.3
A salesperson, instructor, affiliate, student, contractor, Community member, or other person may not modify these Terms unless expressly authorized by Glass Restore in writing.
55. Relationship of the Parties
55.1
These Terms do not create an employment, agency, partnership, franchise, joint venture, fiduciary, representative, or exclusive relationship between the user and Glass Restore.
55.2
Students and Certified Students operate independently and are responsible for their own businesses, customers, employees, contractors, taxes, insurance decisions, representations, and work.
56. Headings and Interpretation
56.1
Section headings are provided for convenience and do not limit the meaning of the provisions.
56.2
Words such as “including” and “includes” mean “including without limitation.”
56.3
The singular includes the plural when appropriate, and the plural includes the singular.
56.4
Electronic records, copies, and signatures may be treated as originals to the extent permitted by law.

58. Acceptance
